Customer Guarantee and Contract

I, Tracy Jo Peterson, agree to SELL a (male/female) St. Bernard. AKC Litter #_______________, whelped __________, sired by ________________, out of ____________, to the buyer ___________________ whose address is ____________________________ Phone_____________________ for the sum of $_______. The buyer agrees to pay $300.00 to reserve the right to purchase a puppy from this litter.  This will be a deposit towards the purchase price of the puppy. The balance to be paid at the time of shipping/possession is $________. This animal and registration papers applying to this animal will remain the property of the seller until final payment is made. Deposits can be transferred to another litter if no appropriate puppy is found in this litter, but is NOT refundable.

The puppy you purchased from Tracy Jo Peterson is guaranteed to be healthy at the time of purchase.  It will be current on its vaccinations and worming.  It is the responsibility of the buyer to keep up on the puppy’s vaccinations and worming.  I recommend that you talk with your vet and set up a continuation program. 

I guarantee the puppy for 5 days from the date of purchase.  If the puppy should show symptoms of any sickness in the 5 day warranty period, please contact me immediately at 605-228-9896. 

If the puppy should die of any sickness with in the 5 day warranty period, I must be contacted with in 3 days of the death and a replacement puppy will be provided out of the next available litter of the same breeding and sex.  It is the buyer’s responsibility to provide me with a written veterinarian statement as to the cause of death and to have the puppy sent to a major university for posting if I request it.

I guarantee the puppy against any hereditary or congenital disorders that may interfere with the puppy’s ability to lead a normal life.  This is a one year guarantee which covers disorders such as heart defects, epilepsy, and  hip displasia,.  (EXCEPT DUE TO TRAUMA) In the event of suspected hip dysplasia, the following procedure must be followed.

 1. Notify breeder immediately after hip dysplasia is diagnosed by a licensed veterinarian
 2. At owners expense, send x-rays to breeders vet or OFA for verification
 3. Breeder is not responsible for any vet bills inquired by buyer
 4. Purchaser understands that adverse environmental conditions for a growing puppy is considered by leading veterinarians to be a major factor in the cause of hip dysplasia. The seller guarantees against hereditary hip dysplasia and will replace due to the owner failing to protect pups growth, environment, nutrition, or problems resulting from any kind of injury or trauma.
 5. Puppy must be returned to breeder BEFORE replacement of equal value is given.
 Breeder has 1 year to replace the affected puppy with one of equal value and breeding.

It is hereby understood by both the buyer and seller of the puppy that the buyer is responsible for any and all veterinarian costs of every kind and nature after the date of purchase.

The buyer agrees that, should he ever decide to part with this dog, that I will have first option to buy, at a mutually agreeable price. Should the buyer’s situation change in that he can no longer care for this dog, he must notify me immediately. I will take the dog back or assist in finding a suitable home for it. AT NO TIME will this St. Bernard dog be surrendered to a shelter or humane society. I will always assist in placing this dog.  If the dog is sold or given away without my consent,  a $500 fine will apply.

I have provided this puppy with the best possible health care, grooming, and socialization, so s/he is off to a good start. Buyer agrees to provide this puppy with proper housebreaking, ongoing socialization, and basic manners; to confine the puppy in a fenced yard or exercise it on a leash for its safety; and to provide a good quality food, annual medical examinations, and routine health care including vaccinations, worming, and heartworm preventative. Obedience classes are highly recommended, not only as a way of preventing behavior problems, but as a means of developing good communication between dog and owner.  I am always available as a resource for information on training and socialization -- don't be afraid to call or email with your questions!!!

 

If the puppy is purchased for show purposes or if the purchaser ever intends on trying to breed the following dog and this is agreed upon by both seller and purchaser, the puppy will be issued FULL registration. However, picking out show pups is an estimated guess at that and it is impossible to predict future development of puppies. There are no warranties as to show quality and the ability to earn AKC points. Nor are there any warranties to produce offspring.

 

If the puppy is purchased as a pet/companion and is not purchased for show or breeding, the pup will be issued LIMITED registration. Pups purchased with limited registration are sold at a lesser price to cover spay or neutering of the dog.

No other guarantees are made or implies by Tracy Jo Peterson except those stated in this written guarantee and all guarantees are strictly on a replacement basis.
